EULA
Applications accessible via the App Store are granted to you under license, rather than being sold. Your licensing for each application is contingent upon your acceptance of either the Licensed Application End User License Agreement (“Standard EULA”) presented here, or a bespoke end user license agreement between you and the Application Provider (“Custom EULA”), should one be provided. The license for any Apple application under the Standard or Custom EULA is bestowed by Apple, whereas the license for any Third Party application is granted by the respective Application Provider. Collectively and individually, any application governed by the Standard EULA is referred to as the “Licensed Application.” The Licensor, which may be the Application Provider or Apple as applicable, retains all rights not expressly delegated to you under the Standard EULA.
a. License Extent: The Licensor extends to you a non-transferable right to utilize the Licensed Application on any Apple-branded devices that you possess or oversee, in accordance with the Usage Rules. The provisions of this Standard EULA shall preside over any content, materials, or services accessible from or procured within the Licensed Application, as well as any updates provided by the Licensor that either replace or complement the original Licensed Application, unless accompanied by a Custom EULA. Except as permitted by the Usage Rules, you are prohibited from disseminating or making the Licensed Application accessible over a network for concurrent use by multiple devices. You are not authorized to assign, redistribute, or sublicense the Licensed Application, and should you sell your Apple device to a third party, you are required to uninstall the Licensed Application from the device prior to the sale. You are forbidden from copying (except as allowed by this license and the Usage Rules), reverse-engineering, disassembling, attempting to uncover the source code of, altering, or creating derivative works of the Licensed Application, its updates, or any component thereof (except to the extent such restrictions are precluded by law or permitted by the licensing terms of any open-source components included within the Licensed Application).
b. Consent to Data Utilization: You consent to the Licensor's collection and utilization of technical data and related information—including but not limited to technical details about your device, system and application software, and peripherals—collected periodically to facilitate software updates, product support, and other services related to the Licensed Application. The Licensor may utilize this information, provided it does not personally identify you, to enhance its products or to offer services or technologies to you.
c. Termination: This Standard EULA remains in effect until terminated by you or the Licensor. Your rights under this agreement will automatically cease should you fail to adhere to any of its stipulations.
d. External Services Access: The Licensed Application may provide access to External Services belonging to the Licensor and/or third parties. You agree to engage with these External Services at your own risk. The Licensor is not liable for scrutinizing or assessing the content or accuracy of third-party External Services and shall not be held accountable for such. Data presented by any Licensed Application or External Service, including but not limited to financial, medical, and location information, is for general informational purposes and is not warranted by the Licensor or its agents. You pledge not to exploit External Services in a manner inconsistent with the terms of this Standard EULA or that infringes upon the intellectual property rights of the Licensor or any third party. You agree not to utilize External Services to harass, abuse, stalk, threaten, or defame any individual or entity, and acknowledge that the Licensor is not responsible for such actions. External Services may not be available in all languages or in your country of residence, and may not be suitable or available for use in certain locations. You are solely responsible for compliance with applicable laws when using External Services, and the Licensor reserves the right to modify, suspend, remove, disable, or impose access restrictions or limitations on any External Services at any time without prior notice or liability to you.
